SCO: Time for a revised Charter

The expansion in membership of the Shanghai Cooperation Organisation (SCO) is an opportunity to review, possibly revise and widen the scope of its Charter to make it more suited to address the concerns of all its members, including new ones like India. This paper recommends what the changes in the SCO Charter ought to be by comparing it with the successful ASEAN charter.

India-SCO: New Platform, Common Ground

India will host the 19th meeting of the Council of Heads of Government on 30 November 2020. This will be the first meeting of the grouping’s second highest organ, hosted by India. The significance of the event lies in the timing – India’s relations with two fellow memberstates, China and Pakistan, are at an exceptionally low ebb; yet the clear message from the SCO Secretariat and other member-states is: India’s presence in the SCO is highly beneficial to the latter and should be fully leveraged to strengthen it as an important and upcoming intergovernmental organisation. This necessitates a fresh appraisal of options for India.

U.S elections, a China order & India’s position

The recent in-person Quad meeting attended by external affairs minister S. Jaishankar and the India-U.S. 2+2 meeting of foreign and defence ministers in New Delhi, highlights not only the big upgrade in India’s strategic relations with the U.S. but also the enhanced U.S. focus on India, the Indo-Pacific and Asia. Clearly then, the foreign policy of the next U.S. administration will impact India, Asia and the world.

India must back Developing World in Space20

The Space20 is the newest sub-forum of the G20 initiated by Saudi Arabia, with the support of the United Nations Office of Outer Space Affairs. India, on its way to the G20 presidency in 2022, should set a comprehensive Space20 agenda for the democratization of outer space, whereby it can share its space growth story with the developing world and achieve its goal to become a global knowledge epicenter.

Riparian Governance in South Asia

The record of regional cooperation on rivers since India's independence in 1947 is one of several successes, with some contestations. In contrast to the past when governments strove to divide and share river waters, the endeavor has now shifted to thinking about comprehensive river basin development which makes the process even more complex. India’s policy on transboundary river governance must now also be aware of the increasing importance of Indo-Pacific in the global geopolitics.

Re-assessing India’s Non-Personal Data

India is ahead of the curve in considering the regulation of non-personal data. The July 2020 Report by the government-appointed Gopalakrishnan Committee evaluated several aspects of non-personal data including its monetisation. An analysis of the Report, however, reveals some lacunae and questions on the early nature of the assessment since India has yet not yet established rules on the governance of personal data.

Pay up. Don’t appeal judgments.

The central government has announced a stimulus package, a one-time payment solution for liquidity needs. But the real winner will be announcing that all of government, its departments and agencies, should withdraw all domestic arbitration appeals and those it has lost at the tribunal or higher level - and make pending payments. It will positively impact the economy and India’s ratings, and demonstrate efficiency.

UN: Necessary but reformed

The UN turned 75 this year but instead of grand celebrations, the world witnessed an empty UNGA with world leaders addressing it via video screening because of the pandemic. The UN is under unprecedented stress and being shown up for its inability to tackle the challenges of today like the pandemics, climate change, terrorism or global peace and security. The institution's key governing structures, especially the UN Security Council, are inadequate and demand reform. India must now use gritty resolve to ensure its place in these governing structures.

A compelling case for Digital Service Tax

The current notions of physical ‘permanent establishment’ or tangible locational nexus are not well-suited for the taxation of modern digital economy, especially for taxation of business income, rents or revenue creating activities. In a Covid-19 wrecked global economy, where government revenues are under severe stress, there is a compelling case for a market country or the value-creating jurisdiction to tax the income or rents attributable to the concerned market or location.
